There can often be confusion around whether or not cyclists are required to use cycle lanes. This can often result in confusion, arguments, and in worst case scenarios injuries. Read on to uncover the straightforward facts.

Do cyclists have to use a cycle lane?

No, cyclists are under no legal obligation to use cycle lanes as outlined by the Highway Code Rule 61. Whilst this is the case, there can be some confusion on this, this is due to the fact that cycle lanes can sometimes be on the pavement, and are split into two separate sides. These lanes are clearly indicated with lines and symbols, but sometimes a failure to provide proper maintenance can result in cycle lanes being unclear.

Can cyclists use the pavement?

Whilst there’s no legal obligation for cyclists to use cycle lanes, it’s clearly stated in the Highway Code Rule 64 that cyclists must not use pavements. This is confirmed in the Highway Act 1835 and the Roads (Scotland) Act 1984 which state that it’s illegal for people to cycle on pavements.

Alternatives to using the cycle lane

If you’re ever unsure if a pathway is a pavement or a cycle lane, you should always use the road as a backup. Cyclists are encouraged to use the road as they’re faster than pedestrians, which can result in injury to both parties if care isn’t given.

What if I’m pushing my bike?

Alternatively, if you’re a cyclist that’s dismounted and pushing your bike, then you should be using a pavement. This is because you’re technically a pedestrian, as you’re not mounted on your bike.

Remember that it’s important to be aware of the space you take up on the pavement whilst pushing your bike, because of this you should be mindful of other pedestrians using the pavement.

Being safe as a cyclist on the road

Now more than ever it’s important to take extra precautions whilst on the roads as a cyclist. Some safety precautions to be aware of include:

  • Wearing clothing that’s bright, and clearly visible in all conditions
  • Keeping good positioning on the road and be sure to stay clear of any obstacles.
  • clearly signaling when making a turn, this can be done by holding your arm out to indicate whichever way you might be turning
  • Be sure to stay well clear of other vehicles blind spots, this is especially important for larger vehicles.

What to do after being involved in a cycling accident?

Unfortunately, accidents happen, that’s why it’s important to know what to do in the case of a cycling accident. If you’ve been involved in an accident involving a cycle lane, the first and most important thing is to ensure you’re physically okay.

After your accident, you should seek a medical professional to get yourself checked over, and they can give you a report of any injuries you may have sustained from your accident.

If it’s possible, you should take photos of the scene of the accident, and if a third party is involved you should exchange insurance details. As well as this you’ll want to take the contact details of any witnesses of your accident, as they may prove useful in your cycling accident claim.
